Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Tokavy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including Free and Pro plan subscribers.

2. Description of Service

Tokavy is a desktop utility that refines AI prompts via keyboard shortcuts. It operates by sending selected text to Tokavy's backend API, which processes and returns a compressed or enhanced version of the prompt. The Service is provided "as is" and may be updated, modified, or discontinued at any time.

3. Eligibility

You must be at least 13 years old to use Tokavy. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. Accounts and Plans

Free Plan: Available to all registered users. Provides 25 prompt refinements per day at no cost.

Pro Plan: A paid subscription providing 200 refinements per day, priority routing, and early access to new features. Billed monthly. You may cancel at any time; access continues until the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Generate, distribute, or process content that is illegal, harmful, or violates third-party rights
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Circumvent rate limits or use automated scripts to abuse API access
• Resell, sublicense, or redistribute the Service or its output without written consent
• Interfere with the integrity or availability of the Service or its servers

6. Intellectual Property

All trademarks, logos, software, and content comprising the Tokavy Service are owned by or licensed to Tokavy. You retain full ownership of any prompts you submit. You grant Tokavy a limited, temporary license to process your prompts solely for the purpose of delivering the Service. We do not use your prompts to train models or share them with third parties.

7. Payments and Billing

Pro plan payments are processed by third-party payment providers. By subscribing, you authorize recurring charges to your payment method. All prices are listed in USD unless otherwise indicated. Tokavy is not responsible for any fees imposed by your bank or payment provider.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. Tokavy does not guarantee that the Service will be error-free, uninterrupted, or produce any specific output quality. Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Tokavy and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by cancelling your subscription and ceasing use of the Service. Upon termination, your right to use the Service ends immediately.

11. Changes to Terms

We may revise these Terms at any time. We will notify registered users of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved in the courts of competent jurisdiction.
